The General Conditions of Sale contained in this document regulate all relations between the company Sucesores de Urbistondo S.L. hereinafter "Hotel de Londres y de Inglaterra" with Tax Identification Code no. B-20673059 and registered office at calle Zubieta 2, 20007 Donostia-Sebastián, Spain. B-20673059 and domiciled at Calle Zubieta 2, 20007 Donostia-San Sebastián, Spain, registered in the Companies Register of Gipuzkoa, Volume 1771, Book 0, Folio 1, Section 8, Page SS-16238 1st Entry, with telephone number: 943440770 and email address (include email), and customers or persons wishing to purchase a product or service offered in the online boutique (https://boutique.hlondres.com/es/), hereinafter "the Customer".
These conditions apply exclusively to natural persons who are considered consumers for the purposes of RDL 1/2007 of 16 November 2007. All relations between Hotel de Londres y de Inglaterra and the Client shall be governed by the provisions of these General Terms and Conditions of Sale, which shall constitute the contract between the parties, unless they contradict any unwaivable rule, in which case the latter shall prevail. Hotel de Londres y de Inglaterra reserves the right to modify these General Conditions of Sale at any time. The purchase of a product or the contracting of a service implies acceptance by the Client of these General Conditions of Sale.
1 - PURPOSE
The purpose of these conditions is to define the mutual obligations of both parties in the context of the distance selling of products and services by Hotel de Londres y de Inglaterra to the Customer.
2 - ORDER
The Customer may place an order directly through the online shop, by email or by telephone with a reservations representative. Any order implies full acceptance of the prices, conditions and specifications of the products. The Customer expressly accepts these General Terms and Conditions of Sale prior to the confirmation of his order. The data recorded by Hotel de Londres y de Inglaterra at the time of the order constitutes evidence of the Customer's knowledge and acceptance of the present General Conditions of Sale. Prior to placing an order, the Customer has been informed of the general conditions of shipment of the product, available at www.gls-spain.es, in the event of such shipment, so that at the time of placing an order, the Customer expressly accepts these conditions of shipment.
3 - PRICES AND PAYMENT
The products and services are supplied at the price in force at the time the order is placed, which will be those published in the online boutique. Prices are expressed in euros, all taxes included, except for shipping costs (if applicable), which implies the Spanish VAT at the normal rate. Any change of rate may be adjusted and added to the price of the products or services at the time of placing the order. For all products shipped outside the European Union the price will be calculated exclusive of tax. Customs duties, local taxes, import licenses or government taxes may apply. These duties and taxes shall be borne entirely by the Customer in relation to declarations for payment to the competent authorities and/or agencies of the country. Orders shall be paid in Euros by credit card: VISA, MASTERCARD or AMERICAN EXPRESS. The Customer's credit card will be charged on the day on which the order is processed or, at the latest, on the day on which the products are dispatched or the service is provided. The products shall remain the property of Hotel de Londres y de Inglaterra until the Customer has paid for them in full.
4 - AVAILABILITY
Our offer of products, services and prices is valid as long as there is availability of stock and dates offered for the provision of certain services. In the event of unavailability of a product or of a date chosen by the Client for the provision of a service, the Hotel de Londres y de Inglaterra is obliged to inform the Client immediately after checking the unavailability. However, Hotel de Londres y de Inglaterra reserves the right to split the delivery of an order in the event of the temporary unavailability of one of the products ordered. In the event that a product or service becomes unavailable after an order has been placed, Hotel de Londres y de Inglaterra will credit the Customer's credit card once it has been informed of the situation, within a maximum of 15 working days.
5 - DELIVERY
In the event that delivery is required, the products are sent to the delivery address provided by the Customer when placing the order. Delivery will be made within approximately ten (10) days, provided that it is a shipment to European Union countries. Shipping costs are not included in the price of the products and services published in the online boutique, and will be specified to the Customer at the time of placing the order. For any shipment outside the European Union, the delivery time and consequent costs may vary depending on the destination. Additional charges may apply for deliveries to islands (e.g. the Ile de Ré, Canary Islands, Balearic Islands, etc. ....). In the event that the unavailability of a product makes it necessary to split the shipment, the Customer shall only pay the costs corresponding to a single shipment. Deliveries are made by a transport company. Hotel de Londres y de Inglaterra cannot be held responsible for the consequences of a delay in delivery. The Customer must notify the carrier and Hotel de Londres y de Inglaterra of any issues relating to the delivery (e.g. damaged package, already opened...) within three (3) days of receipt of the product.
6 - VALIDITY
All our gift vouchers and vouchers are valid for one year from the date of purchase and are subject to the availability of the establishment concerned. The period of one year is understood to be the period in which the service purchased must have been provided. The choice of the date on which the service is to be provided requires prior online booking via the link provided on the gift voucher/voucher or, in the case of an experience without accommodation, by telephone or email. It is compulsory to book in advance and present the voucher on arrival at the corresponding establishment.
7 - RIGHT OF WITHDRAWAL AND REFUND
In accordance with the provisions of Article 103 (l) of the Revised Text of the General Law for the Defence of Consumers and Users, being the products and services offered in our online boutique accommodation services for purposes other than serving as a dwelling, food and services related to leisure activities subject to a specific date or period, the Customer shall not be entitled to withdrawal once the purchase has been executed. Consequently, all our gift vouchers and vouchers are non-refundable and are subject to a cancellation penalty of 100% of the amount paid. Likewise, changes or modifications to the dates contracted by the Client for the provision of the services are not permitted. In the event that a gift voucher with physical delivery is defective, the Client must immediately inform Hotel de Londres y de Inglaterra and return the voucher to the following address within 10 working days from the date of receipt: Hotel de Londres y de Inglaterra, calle Zubieta 2, 20007 Donostia-San Sebastián. Upon receipt of the product and after qualitative and quantitative verification, Hotel de Londres y de Inglaterra will proceed, at the Client's choice, to exchange or refund the product. In this case, the return costs will be reimbursed to the Client on the basis of the initially invoiced shipping cost. The refund will be made directly by crediting the Customer's credit card within 15 working days of receipt of the product by the Hotel de Londres y de Inglaterra.
8 - LIABILITIES
The products and services offered are in accordance with European legislation. Hotel de Londres y de Inglaterra accepts no liability in the event that they do not comply with the legislation of a country that is not a member of the European Union. It is the Customer's responsibility to verify with the local authorities the possibilities of importing or using the products ordered. The photographs of the products displayed in our boutique are not contractual in nature. Hotel de Londres y de Inglaterra cannot be held responsible for the non-execution of the contract in cases of flood, fire, riot, general or partial strike, in particular of transport or communication services.
9 - APPLICABLE LAW - DISPUTES
In the event of litigation, if no amicable agreement is reached between the parties, these conditions shall be subject to Spanish law. In the event of litigation, the client and Hotel de Londres y de Inglaterra expressly agree to submit to the courts and tribunals of the city of San Sebastian, renouncing any other general or special jurisdiction that may correspond to them.
10 - MODIFICATIONS TO THE TERMS AND CONDITIONS OF SALE
The Hotel de Londres y de Inglaterra reserves the right to modify the General Conditions of Sale at any time.
